U.S. documents for an Indian recipient

A university, registrar, bank, employer, court or government office in India may ask for different documents even when the underlying purpose sounds similar. Start with that recipient's written checklist, the state or federal agency that issued each record, and the date you need the completed package. India and the Hague Apostille Convention

India acceded to the Apostille Convention on October 26, 2004, and it entered into force for India on July 14, 2005. The United States acceded on December 24, 1980, with entry into force on October 15, 1981. The current HCCH status record shows no objection preventing application between the United States and India. Objections affecting India's relationship with other countries should not be mistaken for a restriction on U.S. documents. Our team checks the country of origin rather than assuming every country follows the same route.

What an apostille establishes

An apostille authenticates the signature, official capacity and, where appropriate, seal or stamp on a covered public document. It does not certify that the document's contents are true, grant a visa, resolve citizenship or make a foreign degree equivalent to an Indian qualification. The Convention includes court and administrative records, notarial acts and certain official certificates. Documents executed by diplomatic or consular agents and administrative documents dealing directly with commercial or customs operations are outside its scope. Those exclusions do not mean that every document used by a business is excluded.

Apostille and Indian consular attestation are different services

India's Ministry of External Affairs states that an apostilled document from an applicable Convention country should not need further Indian attestation or legalization for use in India. A separate consular procedure—such as a requested consular certificate or registration—may still have its own supporting-document checklist. Current mission pages also describe attestation services for applicants who specifically need those services. If instructions appear to demand both an apostille and extra consular attestation, ask the recipient to identify the exact procedure. We review that instruction with you instead of automatically adding an unnecessary legalization stage.

State, federal agency and federal court records

A U.S. document's origin determines its authentication route. State vital records, state court copies and state-authorized notarizations generally follow the relevant state route. An FBI Identity History Summary is a federal document and does not receive a state apostille merely because its holder lives in Florida. Federal court records can involve a designated court authority and should not be treated as identical to every federal agency record. Miami Dade Apostille coordinates the applicable authority after reviewing the issuer, signature and document format. We coordinate documents issued in all 50 U.S. states and federal records.

Birth certificates and family evidence

For a U.S. birth record, identify the government custodian that can issue the required certified version. A hospital keepsake, scan or ordinary photocopy is not automatically interchangeable with that record. An Indian family or nationality-related procedure may ask for evidence linking the child, parents and earlier names. Ask the recipient whether it needs parent details, a particular certified format or additional supporting records. Apostilling the birth certificate authenticates the covered official signature; it does not itself register a birth with an Indian mission or establish eligibility for Indian citizenship.

Marriage certificates and OCI supporting records

Use the official marriage record requested by the recipient, rather than assuming a ceremonial certificate or an unrecorded license will suffice. The current OCI guidance expressly allows a marriage certificate from a Hague Convention country to be accepted with that country's apostille without further authentication. This is a document-authentication rule within an OCI procedure, not a promise that every spouse qualifies for an OCI card. Different marriage registration or family-law matters can require other records, so send the actual checklist to our team for preparation review.

Divorce decrees, custody orders and legal recognition

An apostille on a certified U.S. divorce decree or custody order does not decide whether an Indian court will recognize or enforce that judgment. Indian official guidance discusses issues such as jurisdiction, the merits of the case, notice and procedural fairness when foreign judgments are considered. Have an Indian legal adviser address recognition or remarriage questions. For document preparation, tell us which order and certifications the recipient requested; do not assume a brief case summary, a docket printout and a certified final judgment are interchangeable.

Powers of attorney for property, banking and family matters

A power of attorney should use wording accepted by the Indian lawyer, bank, registrar or other intended recipient before it is signed. The recipient may distinguish a general authorization from a document for one transaction and may require particular witnesses, photographs or attachments. U.S. notarization followed by the appropriate apostille and a separately requested Indian consular service are different arrangements. Legal powers, property rights and any later Indian registration or stamp requirements must be confirmed with the responsible adviser or office.

Affidavits and remote online notarization

An affidavit or declaration is not automatically a government-issued certificate simply because a notary witnesses the signature. Confirm whether the Indian recipient accepts the proposed document and whether signing must be physical or can use an eligible remote online notarization. Miami Dade Apostille offers remote online notarization where appropriate, but availability does not establish acceptance by every bank, registrar or consular procedure. Send the proposed form and recipient instructions before signing so our team can review the requested notarial and delivery format.

School records, diplomas and professional qualifications

Ask the receiving institution whether it needs the diploma, official transcript, an institutional certification or a particular combination. A notarized copy and an official university record serve different purposes. An apostille does not establish academic equivalence or a professional license. UGC's 2025 regulations provide a separate framework for equivalence of covered foreign qualifications; regulated professional fields such as medicine, pharmacy, nursing, law and architecture are outside that framework. The relevant institution or professional council must confirm its own requirements before our team prepares the requested records.

FBI reports and police certificates

A request for a police certificate should identify the country, authority, reporting period and permitted age of the result. An Indian Police Clearance Certificate, a U.S. local police letter and an FBI Identity History Summary are different records. Do not order all three without a reason or assume that every Indian visa or OCI application requires an FBI report. When an FBI report is specifically requested, Miami Dade Apostille can coordinate the applicable federal apostille service. Fingerprinting, report preparation and federal processing have separate requirements and variable timelines.

OCI, citizenship and visa applications

An OCI cardholder is a foreign national; OCI is not Indian citizenship or a general form of dual Indian citizenship. Birth, marriage and citizenship evidence may support a particular application, but apostilles do not determine the applicant's eligibility. Visa categories also depend on the intended activity, nationality and current rules. Confirm the relevant official checklist before purchasing a document service. Our role is to coordinate the requested document preparation, not to complete the application, select immigration status or promise approval.

Translations depend on the procedure

There is no safe rule that every English U.S. document must be translated into Hindi for India. For example, current OCI guidance asks for an authorized English translation when a marriage certificate is in a language other than English; it separately addresses English or Hindi translations of foreign-language custody orders. A court, university, bank or another office may specify a different language or certification. Obtain those instructions first. Death records and estate-related documents

A death certificate for an estate, insurer or family procedure is different from consular death registration or documents for transporting remains or ashes. Indian missions publish separate life/death service arrangements, with some direct services retained even where other work goes through an outsourced provider. Identify the actual purpose and recipient before requesting certifications. For a U.S. estate record or death certificate, our team reviews the issuing authority and required format; an apostille does not transfer property, settle an estate or authorize transportation.

Company documents and transaction records

A U.S. company's certified formation record, a notarized authorization and an administrative customs document do not all follow one authentication rule. The Apostille Convention's commercial/customs exclusion is specific, not a blanket exclusion for all corporate records. The Indian Embassy currently directs U.S. commercial-document authentication toward U.S. authorities rather than offering routine consular attestation. Choose the correct mission and service channel

For Florida residents, the Consulate General of India in Atlanta is the relevant career consulate in the current U.S. jurisdiction list. A VFS Indian Consular Application Centre is an authorized service-provider location, not an additional embassy or consulate. Several missions now route routine and miscellaneous services through VFS while retaining specified direct services. Boston and Los Angeles also have newer service arrangements that can differ from older directory text. Confirm your residence, service category, appointment and current intake location before visiting. The directory below separates government offices from application centres.

Frequently asked questions

Does India accept a U.S. apostille?

The Apostille Convention applies between the United States and India for covered public documents. India joined by accession on October 26, 2004, and the Convention entered into force for India on July 14, 2005. Authentication does not guarantee that a particular document satisfies a visa, property, academic or family-law requirement. Contact Miami Dade Apostille with the recipient's instructions so we can review the correct preparation route.

Do I need Indian embassy legalization after an apostille?

For a covered U.S. public document used in India, MEA states that an apostille should remove the need for further Indian attestation or legalization. Separate consular certificates or registration procedures can still have their own checklists. If a recipient asks for an extra step, confirm the exact service and reason; do not assume every apostilled document needs to go through an Indian mission.

Can you help with a power of attorney for India?

Some current OCI instructions specifically use English translations for non-English marriage certificates, while other offices may request a different format. Does an apostille make me eligible for OCI or an Indian visa?

No. OCI eligibility, citizenship and visa decisions are separate from authenticating a supporting document. OCI is a status for foreign nationals and is not Indian citizenship. Will an apostilled U.S. diploma automatically be equivalent in India?

No. Authentication and academic equivalence are different.
