Portugal's Apostille Convention dates and U.S. applicability

Portugal ratified the Apostille Convention on December 6, 1968, and it entered into force for Portugal on February 4, 1969. The United States acceded on December 24, 1980, with entry into force on October 15, 1981. The Convention currently operates between Portugal and the United States; the HCCH record shows no objection preventing that bilateral relationship.

Apostille, legalization and the limits of authentication

For covered U.S. public documents that require authentication for Portugal, an apostille replaces the diplomatic or consular legalization formality. It authenticates the relevant signature, official capacity and seal or stamp, rather than approving the contents or the application. State, federal-agency and federal-court records take different routes

A state vital record follows its issuing jurisdiction's designated authentication route even when the owner lives in Florida or Portugal. Federal-agency documents such as FBI results use the U.S. Department of State route, while federal-court documents have designated court authorities. Birth, marriage and death records in the requested version

Use the official custodian where the event was recorded when a replacement certificate is needed. First show us the Portuguese recipient's request and the records you already have. Some nationality procedures prefer full-copy birth records and require evidence connecting generations. A simple photocopy or a scan for preliminary review is not automatically the certified record needed for the final application.

Preparing to marry in Portugal

For a planned marriage in Portugal, the responsible civil registry determines the evidence for the couple's circumstances. IRN identifies identity documents, birth records and evidence of capacity to marry, with a statement addressing countries that do not issue the relevant capacity certificate. Registering a marriage already celebrated in the United States

Marriage transcription records a marriage performed abroad in the Portuguese civil-registration system; it is separate from organizing a new marriage. IRN describes the foreign marriage certificate and applicable supporting birth or prenuptial records. A marriage already celebrated before Portuguese consular authorities does not need that separate transcription. Confirm the current case-specific checklist with the responsible office, then bring the U.S. document request to Miami Dade Apostille.

Apostilles do not complete Portuguese recognition of a divorce

Authenticating a U.S. divorce judgment does not itself give the judgment legal effect in Portugal. Portuguese law generally provides for review and confirmation of foreign private-rights decisions, subject to applicable treaties and exceptions. Ask the competent authority or a Portuguese lawyer to confirm any recognition procedure needed for your intended use. IRN allows the Portuguese translation of documents written in English, French or Spanish to be waived in specified registry procedures when the competent official understands the language. Other official checklists request certified Portuguese translations, so English is not automatically exempt for every application. Visa and residence documents follow the current category checklist

A visa application and an AIMA residence procedure have their own document instructions. The Portuguese Embassy in Washington provides separate checklists for different visa categories. FBI background checks and state criminal-history reports

An FBI Identity History Summary is a federal record; a state background check comes from a different issuing authority. A state apostille cannot authenticate the FBI's federal signature. Powers of attorney, affidavits and eligible online notarization

Have the Portuguese recipient or legal adviser provide the intended wording and execution requirements before you sign a power of attorney or affidavit.
