Overview

Apostille and Notary Services in Westchester

Certified copies of birth, marriage, and death records are obtained through Miami-Dade County or the Florida Department of Health, and the apostille itself is issued by the Florida Department of State or, for federal documents, the U.S. Department of State in Washington, D.C. An apostille is a government certification; the role of an apostille service is to review the document, confirm which authority applies, complete any required notarization, submit the paperwork correctly, and return the finished document to the client.

State vs. Federal

State Apostilles vs. Federal Apostilles

Documents issued by a state agency — such as a birth certificate, marriage certificate, or notarized power of attorney — are apostilled by that state's Secretary of State. A Florida-issued document is apostilled in Tallahassee; a document issued in another state must be apostilled by that state instead. Documents issued by a federal agency, such as FBI background checks, USCIS records, or certain IRS and USPTO documents, require a federal apostille issued by the U.S. Department of State in Washington, D.C. A state office has no authority to apostille a federal document.

Vital Records

Birth, Marriage, Divorce, and Death Certificate Apostilles

Birth certificates, marriage certificates, divorce decrees, and death certificates are among the most frequently apostilled documents for Westchester families pursuing dual citizenship for Venezuela, Spain, Italy, and other countries. Only a certified copy issued by the state's vital records office or clerk of court qualifies for apostille; notarized photocopies are not accepted for these document types. Vital records issued in a different U.S. state must be apostilled by that state's Secretary of State, since each state can only apostille documents it issued.

Cuba is not a member of the Hague Apostille Convention. Documents intended for use in Cuba require consular or embassy legalization rather than an apostille.

If a certified copy is damaged, bears an uncertifiable signature, or the recipient authority requires a document issued within a specific period, a new certified copy should be requested from the issuing state before the apostille can be completed. An older certified copy is not automatically invalid; replacement is required only in those circumstances.

FBI

FBI Background Check Apostille for Westchester

FBI Identity History Summary reports are federal documents and require a federal apostille from the U.S. Department of State in Washington, D.C.; a Florida state apostille cannot be attached to an FBI report. This is a frequent request from Westchester residents applying for residency, citizenship, or work permits abroad.

Academic

Diploma, Transcript, and Enrollment Letter Apostilles

Diplomas, transcripts, and enrollment verification letters from Florida International University, Miami-Dade College, and local schools are apostilled for study abroad, foreign employment, and professional license recognition. Preparation depends on the issuing institution and state: a registrar-certified true copy may be accepted, or a notarized statement from the registrar may be required. Registrar certification alone is not automatically sufficient for all receiving authorities. A Florida Notary Public cannot attest copies of Florida public school records.

Professional licenses must be in an agency-certified eligible form before apostille.

Immigration & Corporate

Immigration Paperwork and Corporate Document Apostilles

Immigration-related paperwork, corporate records, and estate planning documents are commonly apostilled for Westchester families and business owners with legal or property matters abroad. This includes Certificates of Good Standing, corporate resolutions, powers of attorney, and court judgments. USCIS originals or agency-certified copies in eligible form may qualify; downloaded copies or notarized originals are not the same as agency-certified documents. Powers of attorney are frequently apostilled for clients who need a representative to manage a family, property, or legal matter abroad — the signature must be notarized before the document is eligible for apostille. Remote Online Notarization (RON) is available for powers of attorney — eligible signers can be anywhere in the world — subject to identity verification, witness, document, and recipient-country rules; this is not legal drafting.

Real Estate

Real Estate Document Apostilles

Real estate closing documents and deeds are apostilled for Westchester clients completing international property purchases or sales, or transferring property to family members abroad. These documents generally require notarization and, depending on document type and jurisdiction, recording with the county before they are eligible for apostille. Recording is a legal requirement that depends on the type and jurisdiction — it is not a blanket apostille prerequisite.

Court Documents

Court Judgments and Legal Document Apostilles

Court judgments, custody orders, and adoption paperwork can be apostilled for use in foreign legal proceedings, provided they are certified copies issued by the relevant Florida court. Sworn affidavits can also be apostilled once properly notarized.

Common Rejection Reasons

Common Reasons Apostille Requests Are Rejected

  • Submitting a plain photocopy instead of a certified copy
  • Requesting a state apostille for a federal document, or the reverse
  • Missing required notarization
  • Providing an uncertified translation
  • Document damaged or bearing an uncertifiable signature requiring a new certified copy

Translations

Certified Translations for Westchester Clients

Many countries that accept apostilled U.S. documents also require certified translation into their official language. Whether notarization or apostille of the translation itself is required depends on the receiving country. This is a common need for Westchester clients preparing documents for Venezuela, Spain, and Italy. Cuba documents may also require certified translation, paired with consular legalization rather than an apostille since Cuba is not a Hague Convention member.
